Terms and Conditions for Workshops, Trainings, Courses and Events

​The following terms & conditions (TaC) apply to all workshops, trainings, courses and events (hereinafter events) offered by mimacom consulting ag (hereinafter "m/c"), unless other or deviating agreements have been made for individual events.


1. Registration

1.1 The registration can be made online (, by e-mail ( or letter and is legally binding. The registration is accepted if not rejected within 10 (ten) days. m/c will confirm the participation by sending a confirmation of registration.

1.2 If the registration is made by accepting an offer, it must be duly signed and returned to the contact at m/c. With the written confirmation m/c legally accepts the offer and it becomes binding for participants.

1.3 m/c reserves the right to limit the number of participants (minimum or maximum number of participants).

1.4 Registrations will be considered in the order in which they are received.

2. Participation fee and financial terms

2.1 Invoices will be sent to the participants before the start of the event. Payment in due time is a prerequisite for participation. If the payment is not received in time before the start of the event, m/c reserves the right to reallocate the spot for participation otherwise. Section 5 of the TaC applies accordingly.

2.2 To claim a discount or other benefits, make a referencein the registration.


3. Scope of services and event features

The scope of service and features of an event are specified in the respective posting or offer (see also section 1.2).


4. Changes and calcellation

4.1 m/c expressly reserves the right to make changes to the programme, provided that the overall character of the event is maintained. Insignificant changes, changes of performers or the relocation of the place of performance (see section 3.2) do not entitle participants to a reduction of the participation fee or cancellation of their participation at the event.


4.2 m/c reserves the right to cancel an event for important reasons. This is especially the case if a performer is absent or ill, if the minimum number of participants is not reached or in case of a force majeure event. Upon occurrence of such an event. m/c informs the participants about changes and cancellations as soon as possible and announces (if applicable). If m/c cancels an event without offering an alternative, paid participation fees will be refunded. Further claims are expressly excluded (see section 8).


5. Cancellation by participants

5.1 Participants can cancel their registration at any time online (, by e-mail ( or letter without providing reasons for cancellation.

5.2 Upon cancellation up to 20 (twenty) days prior to the start of the event 50% (fifty percent) of the participation fee (plus statutory VAT) will be charged. Thereafter the full participation fee (plus statutory VAT) is due and payable, unless a replacement participant is suggested.

6. Copyright/ Intellectual Property

6.1 Contents, Documents or other working materials handed out at events or made available to the participants are subject to the exclusive copyright of m/c (intellectual property). This includes in particular rights to any products of m/c like documentation, presentations, media, patents, trademarks, internet domain names, trade secrets, database rights, design rights, know-how, techniques, processes and methods. These may not be copied, distributed or published in any way, neither in whole nor in part, not even for the purpose of internal events, without the express written permission of m/c.


6.2 Video and photo recordings during events are expressly not permitted.


6.3 Except as otherwise provided, m/c grants the participants the non-exclusive, revocable, non-transferable right to use the documents and other working materials for their own exclusive purposes within the scope of the event.


7. Data protection

The data provided by the participants in the context of their registration will be collected, stored and processed by m/c only for the purpose of the event, unless the participants have already given their consent to further data processing. Data will only be handed out to third parties if this is absolutely necessary for the execution of the event. Additional information in the data protection provisions.


8. Liability

To the extent permitted by law, m/c hereby excludes any liability for damages of any kind in connection with the execution of events. In particular. m/c waives any liability for a specific technical or economic success, indirect damages, lost profits, lost use, loss of data or other indirect, special or consequential damages of any kind. Liability for slight negligence is expressly excluded, subject to further mandatory legal liability provisions.

9. Final provisions

9.1 Should one of the above-mentioned provisions be invalid, this shall not affect the remaining provisions.


9.2 Unless otherwise stipulated, participants are only granted access to documents, other working materials or product information by m/c other than those mentioned here on the basis of a separate contractual agreement.


9.3 These General Terms & Conditions for events of m/c replace all previous conditions. Oral or written side agreements do not exist or are deemed to be waived.

9.4 The place of jurisdiction for all disputes arising out of or in connection with events of m/c is at the location of the m/c headquarters. These General Term and Conditions shall in all respects be governed by, and construed and interpreted in accordance with, the laws of Switzerland.
